Part 1 – Corruption

I just watched FBI Director James Comey make his announcement that his agency is NOT recommending that charges be filed against Hillary Clinton for her blatant “mishandling” of classified information on her home-brew email setup.

He confirmed that there were hundreds of such emails on her jerry-rig setup, with classifications ranging all the way up to Top Secret SAP (Special Access Program); that any and all people cleared for access to classified data are presumed knowledgeable about the requirements for how such data must be handled; that even unintentional security breaches can be considered criminal offenses; that she forwarded emails containing such information to people outside government employment; that she used her wireless devices while in venues and countries where they were extremely vulnerable to being hacked; that the feds had no idea if they were even able to review all the appropriate emails because of the “cleansing” to the hard drives done by her legal team before turning the drives over to the feds; yet he claimed that her political status had nothing to do with the decision not to recommend prosecution.

To quote Comey: “To be clear, this is not to suggest that in similar circumstances, a person who engaged in this activity would face no consequences.”

Gee… I wonder what former General David Petraeus thinks about that last claim. I guess he must think it’s a real bummer he wasn’t a Clinton when HIS case was being considered…

Translated into the plain English normal people use, Comey’s saying that Clintons don’t have to obey the same laws as the rest of us mere mortals.

corruptionComey also claims there was “no political influence” on his decision. Um… yeah, right. Bill Clinton boards Attorney-General Janet Lynch’s airplane at Phoenix Sky Harbor airport and has a completely private “conversation” with her for 30 minutes, and we’re supposed to believe that was mere meaningless coincidence. At the exact same time that Comey’s making his announcement Her Royal Arrogance Hillary is on an airplane WITH OBAMA on a pre-announced campaign jaunt, and we’re supposed to believe that it’s not meant to be interpreted by Comey and his minions as a clear signal that he should leave her alone.

“Nothing to see here, folks. Move along”. Or, for fans of The Wizard of Oz, “pay no attention to the man behind the curtain”.

Take your pick.

Part 2 – Criminal Intent

As a person who held a Top Secret clearance, let me explain the requirements for how classified material MUST be handled by law, and the issue of “intent” Comey glossed over.

All classified material must be either in a person’s personal possession, and/or secured in an approved container or facility. It may not be taken from its normal facility except in certain instances, and then only with prior authorization. Period.

classified filing cabAny time you’re not actually using a classified document, it must be secured. That means returned to the safe or lockable file cabinet in which it’s normally stored, or in the case of certain types of documents, returned to the secure storage room.

Let’s say it’s the end of your work day and you’re going home. You forget to return a document to the secure safe and leave it on your desk. Guess what? You just committed a security violation, and you’re gonna be cited for it. I’ve known of people who lost their clearances just for doing that, and that’s CLEARLY unintentional, a mistake.

It’s the end of the workday, and you decide to throw that document in your briefcase and take it home to work on it there. That’s a HUGE no-no, and not only will you be cited and lose your clearance, but you’ll probably be criminally charged, too. And since you INTENDED to take it home, that was clear “intent” to circumvent the law.

Note that there was no “intent” to commit espionage by trying to give it to another entity. There was merely “intent” to circumvent the rules on how to handle documents.

Petreaus was criminally charged under circumstances similar to that last example. But Clinton did EXACTLY the same thing, INTENTIONALLY circumventing the rules on document storage and handling. It was her INTENT to ignore those laws. It wasn’t an “accident” that she had an unsecured server at an unsecured location; it was done ON PURPOSE. Whether or not she “intended” to give the data to other unauthorized people is COMPLETELY IRRELEVANT.

That, friends, is the law on handling classified information and documents.

Those servers didn’t just accidentally fall out of the sky and set themselves up in her bathroom.

    Well done. I have also written per my “Dear America” on Mr. Comey and his lack of integrity to follow the rule of law. Jonah Goldberg laid out a TH column that said he chose the lesser of two evils and I completely disagree with it. Petraeus got caught with his pants down and his computer at the paramour’s home, so he gets fired and fined? Da F*ck? There are currently many examples of the peons being fired for self-reporting the errors made and there was a clear indication of “no intent” yet, what happened?

    I am sick to death of this and I have to say that if I were FBI, I would quit for having a director ignore all that they know. USC18 ss 641, 793,798, 1519, 1971, 2001, 2071. SECCA. AYFKM? I could keep going!!!! The very idea that a former first Lady, Senator, SOS has no clue is clearly a lie.

    How much more clarity do you need per Trey Gowdy’s questioning of Comey? #UFB.

      I’m with you 100%. I read Goldberg’s column, too, as well as others who’ve promoted the same tortured and absurd “logic”. I have no idea why they’re making excuses for him. It’s like a teacher saying to the kid, “Oh, your dog ate your homework? Sure, I believe that! That’s what dogs do…”.

      It’s nonsense.

      I absolutely LOVED Gowdey’s questioning of Comey. It cast the whole issue in crystal clarity for the BS it is. Gowdey’s da man.

    I’m sure you have checked USC 18 Section 793 (f) nothing about intent there. I’m with you on this HRC violated the law and nothing will happen to her. Now the FBI has established the Clinton rule for defendants. When I was in the service they had a locked room for Secret radio communication, always kept locked. Watch HRC spin that she doesn’t agree with Comey, she did nothing wrong, etc etc. Nixon could have destroyed all the tapes then, according to the Comey rule.

    I just finished reading Title 18 Section 2017. All I can say is my theory that the left has a strong cadre of researchers who do nothing but dig into the backgrounds of people likely to come up against a leftist proposal or plan. The next most glaring case of twisting the law comes to mind is Justice Roberts but there have been way too many politicians who talked a conservative line but when actually became relevant, well, all of a sudden turned their coat inside out and almost always gave either no excuse or the most flimsiest of excuses.
    Believe me. EVERYONE has a skeleton in their closet. Just like Big Brother said in ‘1984’ we will learn your greatest fear… Remember? The rats? So skeletons in closet are politicians greatest fear…

        20 years ago James Comey as an attorney on the Senate Whitewater Investigation was looking into the conduct of President Bill Clinton and first lady Hillary Clinton.The investigation was to determine whether Bill Clinton used his political position as governor of Arkansas (in the 1980s) to push through an illegal loan to benefit Bill and Hillary’s business partner in Whitewater.         people involved in Whitewater went to jail, but no criminal prosecution was in the cards for Bill and Hillary. Remember James Comey was the Deputy Special Counsel for the Whitewater investigation….

        In Christopher Anderson’s book, American Evita: Hillary Clinton’s Rise to Power, Anderson gives details of the New Square offenders pardon by Bill Clinton (who had been convicted of bilking the government of $30 million dollars). Christopher Anderson relates that at Hillary’s urging Bill gave clemency to 16 Puerto Rican terrorists who took the lives of 16 Americans and wounded many others.Anderson tell us that Hillary admired the Marxist Carl Oglesby and Saul Alinsky. It is from her admiration for Saul Alinsky that she formed her belief that “the only way to make a real difference is to acquire power.”

        The pardon of billionaire Marc Rich (who traded illegally with America’s enemies including Iran) by President Bill Clinton was something that everyone knew reeked of impropriety after learning that Rich’s wife donated $450,000 to the Clinton Library. Again James Comey oversaw investigations of the pardon matters as well.

        And, now, no charges. Really? Nothing to see, here? Not one MFMC picks up on this stuff? Yep. The MFMC keeps pointing to Comey being a Republican, like that is something we should get over, now, #becauseconservative and EVEN HE “exonerated” HRC. Oy.

    She’s not in jail, Obama hasn’t been charged with arming the enemy and a host of other violations, DOJ isn’t under arrest and the list goes on. The integrity of the FBI has been compromised. The Republicans in Congress have been aiding Obama and the Supreme Court of the Nation is bogus. We have terrorist organizations that are given a free pass i.e. BLM, EPA, DOJ, IRS, the other BLM and a host of alphabet divisions of the Executive Branch. The future of our once great nation doesn’t look too bright.

    It seems to me that this event clearly illustrates the disdain with which the political elites view the citizens of this country.

    A rhetorical question: how STUPID do they think we are to accept the outcome of investigations into Hillary’s shenanigans (both Benghazi and email-related) that find her guilty of no criminal wrongdoing?

    We all know the answer to that – pretty damn stupid
    When will we, as an outraged public, finally get tired of being treated as fools?

    When we are exposed to hard, cold facts that Hillary created her own email network, complete with a secret server, in order to circumvent Congress and FOIA access to her emails, we can hardly think of her as “guilty of no wrong-doing.”

    Then, when she was forced to, she deleted (and wiped) about half of the emails stored on that server to keep them from prying eyes. She and her attorneys vetted the emails to separate those that were “work-related” from that were “personal,” (wedding plans, yoga, and family matters). It doesn’t take a genius to believe that the “personal” emails also included financial details about speaking contracts for Clinton Crime Family godfather Bill.

    And Bill just happened to have an unscheduled and unannounced meeting prior to the release of the FBI findings with the Attorney General and they discussed grand kids and Bill’s golf game. Is that ludicrous or what?

    Brian, your Part 2 (Criminal Intent) covers nicely how there is ample evidence of Hillary’s criminal intent scattered across the ether, but it doesn’t go far enough.

    We’ve allowed criminal intent to get a foothold in our government and it is metastasizing before our eyes. Think of all of the actions by Barack Obama that were clearly outside the law. Comey is guilty of dereliction of duty (as a minimum) and probably integral to a conspiracy to keep any (new) taint from sinking the good ship USS Hillary.

    Who among our topmost Federal officials are innocent of lies, obfuscation, and conspiracy to defraud the people of their rights, both financial and political?

    I can’t think of any, can you?

    The events of the last few weeks indicate and prove that the United States is rapidly approaching a Banana Republic or an Elitist-Run Bureaucratic Dictatorship. And at the present rate of “speed”, I figure the ship will be ready to set sail in 2024-2026. I see no reason to discuss the obvious. Hilliary is guilty and should be in prison. However, the DC Bureaucrats and the Elites will cover for her. Unless a miracle occurs, Hilliary wil be the next POTUS. So what do we do?

    As I see it during this election cycle we can:

    1. Vote for Hilliary (who will be the Democrats nominee).
    2. Vote for Trump (who will be the GOP nominee) and hope he gets so many votes that nothing can be done but place him in the White House.
    3. Throw away your vote on a third party candidate.

    I intend on voting for Trump. And please note, I do not like voting for Trump. I dislike him as he is a “loud-mouth” and vulgar person. But compared to what Hilliary will be like as POTUS, I will accept what Trump will probably be as POTUS.

    However, we must expect that the Clintons, Obama, and the Democrats will do every thing short of obvious murder to make sure Hilliary wins the election. And unless I am reading all the “signs” incorrectly, I believe the election will be close with Hilliary winning.

    But miracles do happen, and I will be praying to God for one to occur in November.

    And if a miracle doesn’t occur, then all we have left is the “Lexington and Concord” solution.

      I completely agree.

      As you know, I’ve been VERY vocal in my anti-Trump opinion, but I also believe we’ve reached that point. Damn, I hate to say that! But there it is.

      This action by Comey has pushed me to it, plain and simple.

    Knowing how many people get disappeared around the Clintons, my original theory was that Comey did it for ‘health reasons’ to keep himself and/or family members above ground.

    That theory changed somewhat when I learned he had history with the Don Clinton Corleone family and got me to wondering if that’s why Comey was chosen for the job. That happened in 2013 so the question is how far back do her email issues go? Offhand, I don’t remember seeing or hearing dates or a time frame, so If they go back that far, that may be the connection to why he got the job.

    They’re a lot of things, but stupid isn’t one of them – she had to know this would come out at some point and Comey has certainly proved himself handy to have around.

    There’s another train of thought floating around regarding Gowdy’s questions to Comey. It’s been said that he’s highlighting the lies she told to set her up for perjury charges. Comey admitted that Hillary lied, and since she was under oath, this sets her up for being charged with perjury. A futile effort, imo.

      Well, the problem is that her “statement” to the FBI wasn’t actually taken under oath. BUT, her testimony to Congress WAS.

      So here’s what I think that means. Her FBI interview — and yes, it was an “interview” and not an “interrogation”, which brings different rules into play — was “voluntary”, meaning that she wasn’t sworn, but was no doubt accompanied by her attorney. I’d just LOVE to know how many times she took the Fifth. Now, even in a voluntary statement, if she lies to the FBI she can be charged with a 1001 violation, basically what got Martha Stewart jailed. But, anyway, she probably just answered simple questions without incriminating herself, and voila!… End of story. No perjury.

      She did lie to Congress, and they can prefer perjury charges, but guess WHERE they refer those charges TO. That same DOJ. What do you think the odds are of THAT being successful? It’s like Eric Holder all over again: lying to Congress and skating free. Further, there’s not even enough time left in this congressional session to make even that process happen, what with the required committee actions, floor votes, etc.

      If she’s elected Prez, they can’t impeach her for the perjury, because it happened BEFORE she was Prez. If she loses the election, the new Congress can refer charges, but what would be the point?

      So, by dragging this out as long as she did, she accomplished her goal of skating. The ONLY way justice could have been served was if Comey referred for indictment now.

      A lot of this are the same reasons why Quick-Zipper Bill Clinton wasn’t actually prosecuted for HIS perjury until after he left office.

    Spot on, Brian.

    I watched almost all of the recent hearing where Comey testified on this and by the end all I wanted to do was throw my hands up in the air and yell, “WTF!” There was no logic in his decision whatsoever, and ultimately he couldn’t explain it.

    If you’ve ever seen the movie, The Princess Bride, there’s a great scene where the “genius” character who kidnaps the princess is in a contest of wits with the man who wants to rescue her. Trying to guess whether there’s poison in his cup or in the hero’s cup, the “genius” engages in a comically complicated guessing game but in the end his determination to out-clever his opponent distracts him from the right answer and he drinks the poison. That’s what this reminds me of. Comey made up his mind not to charge Clinton, then he tried to make the justification fit his decision. I think he convinced himself that he was doing something in the interests of the nation (like John Roberts, proving he’s a lib at heart), but all he did was reinforce the fact that the law doesn’t apply to the Clintons.

    Comey did nothing to vindicate his decision, but in the end he doesn’t have to . Democrats will pretend he did, and that’s all Hillary cares about.

      I also agree with the analogy to Roberts, one I’ve made myself in conversation.

      The damage to the country by this act alone can’t even be quantified, IMO.

    This is sort of surprising, given the past animosity toward Obama by the Klintoon Krime Kabal. He could have taken the wind out her shit-sodden sails yet again by having the RIGHT thing done, such as indicting her crooked ass,but oh, no can’t do that.There HAD to be something in it for the Purple Lipped Liar. I don’t see the repubs as having the stones to approve of doing anything that would totally remove this cancer that our governance has been afflicted with. Good piece, pard.

Yet it’s horrifying how corrupt the entire and I stress ENTIRE regime is corrupt and here they are pushing for another corrupt individual to just waltz in to the WH.. Just makes me sick. They have had 8 years to perfect the voting corruption to sway the votes to this woman!!! Did you see how he has announced he in essence wants to
    Federalize all police.. This is the pre-empt to putting us under the UN to run our country, you know , globalize to get this once great country unless the people open their damn eyes to what’s going on! Makes me sick knowing he’s doing all this and yet not a damn soul to stop all of his crapola !! We aren’t republican heavy with votes and yet they do nothing??? Oh, not to feel uncomfortable folks but reality check here, speaker of the house his wife is into this globalization stuff so
    Maybe you can see why they let the dems pass that they could obliterate in our swearing in yo immigrants they DO NOT HAVE TO SWEAR TO BEAR ARMS TO PROTECT THIS COUNTRY!!!       I’ve been saying for a couple of decades now that we’re in the midst of a civil war every bit as fundamental as the one that took place in the 1860s. It’s not a bloody one… yet. That’s the only difference. But nowadays, even the body count is starting to rise. Submitted in evidence: the Dallas shooting of cops.

    Great analysis, Brian. I have lost all faith in our government; it is obvious that our leaders are noting but corrupt people, who only care about consolidating and gaining power at the expense of the rest of us.
